Verde barony: Testament reading

(Year 234, Summer) Testament readings are not regular on this blog, as it is normally reserved royals and the eight top nobility peers - if the testament gets complex. Because the late Auphor Sax-Donnersmalt, Baron  of Verde, was of high nobility until recent couple years, his passing leaves a very complex package of heirlooms, titles and heirs. His testament will affect multiple Houses and an exception had to be made.

House of Sax-Donnersmalt and House of Saxor gathered. Left to right: The Hon. Vitorina Cordenza Sax-Donnersmalt (9), The Hon. Dominus Juan Sax-Donnersmalt (8, currently in boarding school), Dowager Baroness Morgan of Verde (41), Duke Victus of Meadows (60), Lady Corva Saxor (28) and Duchess Gloria of Meadows (78). Only the youngest (4) life heir of diceased was not present. Standing is Judge Alberthin Druemann.

The testament reading took place yesterday at Yuma Heights at Verde, Oasis Springs. All invited were either excited or a bit worried, because several points were not initially sorted out. The widow certainly had hopes for her own children not needing to leave Yuma Heights, but everyone knew that nothing could be taken for granted. Details of the heritage would interfer with each other, deceased's oldest child is not even a member of deceased's House, and peerages and some heirlooms even comes with their own rules. In these circles also strategy will come into play. And we are talking big money.

Judge Alberthin Druemann (71), member of the High Court, was appointed to lead the business. Many relatives gathered, most of them invited because they somehow will be affected by the will.

List of main issues with legal conclution:

1. Life heirs

Deceased was married twice and leaves behind 5 children:

   A. Victus Amador Bent Saxor, the Duke of Meadows (60). 1st marriage.
   B. Victoria Eliza Almina Saxor, deceased. 1st marriage.
   C. Vitorina Cordenza Sax-Donnersmalt (9). 2nd marriage.
   D. Dominus Juan Sax-Donnersmalt (8). 2nd marriage.
   E. Bentoira Alica Sax-Donnersmalt (4). 2nd marriage.

2. Widow

First marriages ended when spouse died in Year 180.

Deceased remarried Year 225, but because it is less than 10 years, a 50/50 share of total free assets is not an option based on the marriage' duration alone. However, Baron Auphor and Baroness Morgan brought in equal top goodwill, meaning the widow is entitled to a 50% split, anyway.

3. Head of House

Deceased was Head of House of Sax-Donnersmalt. New Head would normally be appointed with ease, but due to testament details that might interfer, the family has asked for advice.

Conclusion: The logical next Head of House of Sax-Donnersmalt, due to family name, is The Hon. Vitorina Cordenza Sax-Donnersmalt [C]. She is only 9, and the norm is that Head should be minimum 20. Her mother, Dowager Baroness Morgan of Verde will administrate the House as «Head appointed» until Vitorina's 20th birthday.

The Hon. Vitorina Cordenza Sax-Donnersmalt (9) is formally the next Head of House of Sax- Donnersmalt, but is too young to be Head of House operandus.

The House's main peerage (Verde barony) requires a male successor. Son of the House, The Hon. Dominus Juan Sax-Donnersmalt (8) [D], is only 2nd in line. If the Verde barony will be declined by [A], and the peerage is passed on to [D], it would make sense that [D] is Head of House, raher than his sister [C]. But neither can he operate the House yet due to age. His mother, the Dowager Baroness, would still be appointed, meaning there would be no practical change.

So, the question of Head of House can be debated again in 11 or 12 years, if needed.

4. Peerages

Deceased leaves behind three peerages, none of them seen as high nobility: Verde Barony (including the Verde Trust), Fashino barony, and Con barony.

Verde Barony was created Year 5 and comes with the Verde Trust (§2,070,987). It was seen as high nobility until 2 years ago. It requires a male successor, and Victus Amador Bent Saxor [A] is 1st in line. The rule of no person holding multiple high nobility peerages is no longer affecting this. [A] already holds the Meadows dukedom, and has been pledged to decline the Verde barony. If so, The Hon. Dominus Juan Sax-Donnersmalt [D] will be 2nd in line. [A] must accept or decline Verde barony within 6 months. Morgan F. Sax-Donnersmalt keeps the title Baroness of Verde until further notice. Her new title will be confirmed by Royal Court when there is a change.

Fashino barony was created Year 180 and comes with no values. Heirs rank by Photography skill:
1. Lady Corva Rosalie Victoria Saxor [daughter of A]. Must accept or decline within 6 months.
2. The Hon. Vitorina Cordenza Sax-Donnersmalt [C].

Con barony was created Year 200 and comes with no values. Heir must have the trait of Conflict resolution.
No heir qualifies. [A] will hold this peerage dormantly.

Yuma Heights (§377,000) is the main estate of the Verde barony, and owned by the Verde Trust, but not Baron Auphor's most valuable heirloom.


5. Seperate property

Deceased had registered 50% of his shares in Sim City First Trust Bank (2%) as his separate property. This is the biggest single heirloom aside of the Verde Trust. This means that his widow, Baroness Morgan, is not entitled to a 50% split of this item.

§413,926 is handled separately from the common household values. This equals to 1% shares in Sim City First Trust Bank. In the future calculations the other 1% is still seen as free heirloom.

§2,070,987 (Verde Trust, follows Verde barony, automatically seen as separate property, not affected by testament or heritage law),

Widdow Morgan F. Sax-Donnersmalt has no Separate property registered.

Separate property (not the Trust) can be overruled by testament.


6. Free items

Deceased leaves behind a total of §3,088,069 including separate property. Of this the following items (§603,156) are seen as free:

   §413,925 Shares, 1% Sim City First Trust Bank
   §140,150 Heirlooms
   §49,415 Shares, 1% Reg12 Water
   §36,600 Shares, 12% Mazaloom Equestrian Association
   -§36,934 bank loan

Free heirlooms are, combined with Morgan F. Sax-Donnersmalt's personal posessions, §612,361.
Of this, 50% is Morgan's to keep: §306,181.

The remaining 50%, §306,180 is to be shared by life heirs according to testament and heritage law.

7. Testament reading

It was finally time to read Baron Auphor of Verde's last will! The testament was written 6 years ago.

According to the reading, main heir will be The Hon. Dominus Juan Sax-Donnersmalt, inheriting the max possible 50% of all free heirlooms.

Dowager Baroness Morgan will be his benefitter until he reaches 20 years old. 

Then there is a given priority of which heirlooms Dominus shall have: «Paintings, medals, tableware, jewelries and anything else with a connection to Verde barony that is not already owned by Verde Trust».

There is also a specific quote involving Duke Victus: «Victus Am. Saxor shall receive his heirlooms on request and shall be responded withn 3 years from my death».

The normal procedure will be followed. Main heir will firstly get all possisions, and then pass on to the other benefitters their values, immediately and no later than within 3 years. In other words, Morgan will be the one, on behalf of her son Dominus, to decide what heirlooms shall go to those not being the main heir, including herself.

Peerages are not mentined in the testament, because they have theier own rules separated from the heritage law and can not be directed by anyone.


The verdict:

D. The Hon. Dominus Juan Sax-Donnersmalt, main heir: §191,363

A. Duke Victus of Meadows: §38,273 and Verde barony and Con barony (dormant).

C. The Hon. Vitorina Cordenza Sax-Donnersmalt: §38,272

E. The Hon. Bentoira Alica Sax-Donnersmalt: §38,272

F. Dowager Baroness Morgan (Fyres) Sax-Donnersmalt, widow: §306,181

G. Lady Corva Saxor, diceased's granddaughter: Fashino barony.
